By accessing or using the Site you agree to be bound by these Terms of Use. We may update these Terms from time to time by posting a revised version on the Site. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.

80 Eight SA (Pty) Ltd (Registration Number 2017/435463/07) is an authorised Financial Services Provider, licensed by the Financial Sector Conduct Authority (“FSCA”) under FSP number 49010.

Nothing on the Site constitutes financial advice as defined in the Financial Advisory and Intermediary Services Act, 37 of 2002. Content relating to our products is general in nature. Before using any product or service referenced on the Site, please refer to our Risk Disclosure Statement and, where applicable, the terms and disclosures provided to you directly during onboarding.

Subject to these Terms, 80 Eight grants you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Site for lawful, personal and non-commercial purposes. We may withdraw or suspend access at any time, with or without notice, for maintenance, security, legal or operational reasons. Separate App Terms and Conditions apply when you open an account or use the app.

Content on the Site is provided for general information only and is not a substitute for professional advice or services. Laws and regulations may apply differently depending on your circumstances and jurisdiction. You should obtain appropriate professional advice before acting on any information.

Given the nature of electronic communications and the Internet, we do not warrant that the Site (or any content) will be uninterrupted, error-free, omission-free, secure or free from viruses or other harmful components. The Site and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of accuracy, timeliness, completeness, merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

To the fullest extent permitted by law, 80 Eight and its affiliates, partners, principals, agents and employees will not be liable for any direct, indirect, incidental, special, exemplary, punitive or consequential damages (including loss of data, use, goodwill or profits) arising out of or in connection with your access to or use of, or inability to access or use, the Site or any content, whether based on contract, delict (tort) or otherwise, even if advised of the possibility of such damages.

All content on the Site, including concepts, ideas, methods, procedures, processes, know-how, techniques, programs, publications, models, product templates, technologies, software, designs, artwork, graphics, text, images, logos and other materials, may be proprietary and protected by copyright, trademark and other intellectual property rights owned by 80 Eight or third parties. Any unauthorised use may violate applicable laws.

You may print or share links to content for personal, non-commercial use provided that: (a) all copyright, trademark and similar notices are retained; and (b) the content is not used to imply that 80 Eight provides testimonials or endorsements of any organisation, products or services without our express written consent.

You may not modify, reproduce, publicly display, perform, distribute or otherwise use any content for public or commercial purposes without the prior written consent of 80 Eight or the relevant rights holder. 80 Eight is not responsible if you fail to obtain such consent.

The name and logo 80eight and any related product or service names are trademarks or registered trademarks of 80 Eight SA. You may not use any 80 Eight trademark, logo or trade dress without our prior written authorisation. To request authorisation, please contact us via the Contact page on the Site.

Third party links are provided for convenience. 80 Eight does not control and is not responsible for third party sites or their content. We may protect our reputation and request removal of any link to the Site at our discretion.

You may link to publicly available pages of the Site, provided you do so fairly and lawfully and the link: (a) does not damage or take unfair advantage of our reputation; (b) does not suggest any form of association, approval or endorsement by 80 Eight where none exists; and (c) does not frame the Site or otherwise alter the presentation of our pages.

The following are strictly prohibited: (a) using our logo without authorisation; (b) links that disguise the destination URL, bypass required pages (including those containing copyright, disclaimers or policy notices), or otherwise circumvent Site architecture; and (c) promoting or operating a website purporting to be 80 Eight or affiliated with 80 Eight without our authorisation.

You agree not to: (a) use the Site for unlawful purposes; (b) attempt to gain unauthorised access to any systems or networks; (c) introduce viruses, malware or other harmful code; (d) use any robot, spider, scraper or other automated means to access the Site without our permission; (e) interfere with or disrupt the Site or any user; or (f) remove, obscure or alter any legal notices.

Your use of the Site is subject to our Privacy Policy and Cookie Policy, which explain how we collect and process personal information, including through cookies, web beacons and similar technologies. Please read them carefully.

If you are dissatisfied with any financial service rendered by 80 Eight, please refer to our Complaints Policy, which sets out how to raise a complaint with us and, where necessary, how to escalate it to the Ombud for Financial Services Providers.

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have breached these Terms or for security, legal or operational reasons.

These Terms are governed by the laws of South Africa. The parties submit to the non-exclusive jurisdiction of the South African courts to resolve any dispute arising from or related to these Terms or the Site.

We automatically receive and record internet‐usage information on our server logs from your browser, such as IP address, browsing habits, click patterns, software version, system type, screen resolution, colour capabilities, plug‐ins, language settings, cookie preferences, search‐engine keywords, JavaScript enablement, the content and pages you access on the Site, dates and times you visit, paths taken and time spent on pages. Other websites visited before ours may place personal information within your URL; a subsequent website that collects URL information may log such personal information.

Pages on the Site may include single‐pixel gifs or web beacons to count page views and access cookies. We do not use web beacons to collect personal information and use them to compile anonymous information about the Site.

80eight may monitor and record telephone calls for quality, security and compliance where permitted by law; you may object where applicable.
