Terms and Conditions
These 88 Race Terms and Conditions (“Race Terms”) govern participation in the 88 Race, a points leaderboard run by 80 Eight SA (Pty) Ltd, registration number 2017/435463/07 (“the Company”, “80eight”), an authorised financial services provider (FSP 49010), in partnership with The Dream Boys (“the Race”). These Race Terms are supplementary to, and must be read together with, the Company’s Terms of Use and Privacy Policy, which continue to apply in full. If there is a conflict on a matter specific to the Race, these Race Terms prevail. On any other matter, the Terms of Use prevail.

2. Eligibility
2.1 The Race is open to natural persons who are at least 18 (eighteen) years old and who hold a personal 80eight account that is not closed, deleted, blocked, suspended or restricted.
2.2 An Eligible Person earns invite Points only for Invited Friends who registered using that person’s own code or link. The Race is one level deep: a person earns no Points for someone invited by one of their Invited Friends. For example, if A invites B, A earns Points for B. If B then invites C, B earns Points for C, but A earns no Points for C.
2.3 Business accounts are not eligible.
2.4 The following persons are not eligible to take part in the Race, earn Points, be ranked or win a Prize:
(a) a director, member, partner, employee, agent or consultant of the Company or of The Dream Boys, or of any person who directly or indirectly controls or is controlled by either of them;
(b) a supplier of goods or services in connection with the Race (including a marketing service provider and the independent verifier appointed under clause 8.5), and a director, member, partner, employee, agent or consultant of that supplier; and
(c) the spouse, life partner, business partner or immediate family member (being a parent, child or sibling) of any person in paragraph (a) or (b).
2.5 Only one account may be held per natural person, regardless of the number of email addresses, phone numbers or referral links used. Where more than one account belongs to, or is controlled or beneficially used by, the same person, only one such account is eligible.
2.6 An Eligible Person earns Points only for actions that occur at or after the time the person joins the Race. No Points are calculated for an Eligible Person who has not joined, and only a Racer is ranked on a Leaderboard or can win a Prize.
2.7 The Company may require a person to show that they meet this clause 2 at any time. A person who does not meet it may be excluded under clause 10.3.
3. Joining and leaving
3.1 To join, an Eligible Person must choose a public 80eight username and tick the box on the join screen, which reads: “I agree to the 88 Race Terms and Conditions, and that my @username, points and rank may be shown on the public board and in shout-outs on 80eight and The Dream Boys’ social media. I can leave the Race at any time.” Joining records the person’s acceptance of these Race Terms and their consent to the public display and shout-outs described in clauses 12.1 and 14.3.
3.2 Choose a username that does not identify you. Do not use your real name, identity number, phone number or email address. Your username is also your 88Pay handle and appears in your invite link. The Company may exclude a Racer whose username is offensive, misleading or impersonates another person.
3.3 A Racer receives 25 (twenty-five) Points once, on joining.
3.4 Joining is open until the Close. A person who is not a Racer at the Close is not ranked in the Final Standings.
3.5 A Racer may leave the Race at any time from the Race page in the 80eight app or web app. Leaving removes the Racer from every Leaderboard at the next update, which is about one minute, stops Race notifications from the Company, other than service messages about the Racer’s own joining, leaving, exclusion or Prize, and stops the Racer earning Points. Points already earned are kept on record. The Racer may rejoin before the Close and then earns Points again from the time of rejoining.
3.6 A Racer may hide from the Deposits Leaderboard at any time. Points for the Racer’s own deposits then continue to count on the Overall Leaderboard.
3.7 If these Race Terms change before a person joins, the person must accept the version in force when they join.
4. Points
4.1 Points are awarded for the actions, and in the amounts, set out in the Points Table. The Points Table at the Start is in Schedule 1.
4.2 An action earns Points at the time it occurs, not at the time it is processed.
4.3 Points for an Invited Friend’s KYC Approval are awarded only for the first 80eight account ever opened on that Invited Friend’s identity number. Where the Company holds no identity number for an Invited Friend, Points for that Invited Friend are awarded but are subject to the review under clause 8.3 and are cancelled if the Company cannot establish that the Invited Friend is a genuine and unique person.
4.4 Points marked “pending” in the Points Table are held for 24 (twenty-four) hours. Pending Points do not affect a Racer’s rank. They are cancelled if the qualifying action is reversed within the hold, including where a withdrawal within the hold takes the Invited Friend’s credited deposits below R100.
4.5 Each qualifying action earns Points once only.
4.6 Points are recorded to two decimal places and displayed as whole Points, rounded down. Ranking uses Points as recorded.
4.7 Points are a score for the purposes of the Race only. They have no cash value, cannot be transferred, exchanged or redeemed, are not property or a financial product, and lapse at the Close.
4.8 A Racer earns Points for the Racer’s own deposits, as follows:
(a) 1 (one) Point is awarded for each R100 of the Racer’s own deposits in South African Rand, once the deposit has been credited to the Racer’s 80eight account. The Company checks at the review under clause 8.3 that the deposits came from the Racer’s own funds, and a Racer who earned Points from deposits that did not may be disqualified under clause 10;
(b) these Points are Pending Points for 24 (twenty-four) hours;
(c) these Points are limited to 250 (two hundred and fifty) Points per day, being R25,000 of deposits, and 1,500 (one thousand five hundred) Points over the Race Period, being R150,000 of deposits;
(d) these Points count at one quarter of their value on the Overall Leaderboard, so they add at most 375 (three hundred and seventy-five) Points to a Racer’s Overall total; and
(e) a withdrawal within the 24-hour hold cancels the most recently earned Pending Points for own deposits first, so that depositing and withdrawing earns nothing.
4.9 A Racer is not required to make any deposit, payment or purchase to join the Race, earn Points or win a Prize, and no Prize depends on a Racer having made a deposit. Points for a Racer’s own deposits are optional. Points are also awarded when an Invited Friend makes a deposit (see the Points Table). Points are never a reason to deposit more than you intend to: deposit only funds you are comfortable holding with the Company, and read its risk disclosures first.
4.10 The Company may correct Points awarded in error.
5. Leaderboards and ranking
5.1 Points count on each Leaderboard they belong to:
(a) Overall: all Points, with Points for a Racer’s own deposits counted at one quarter;
(b) Invites: Points for Invited Friends registering and receiving KYC Approval;
(c) Friend Deposits: Points for Invited Friends’ first deposits; and
(d) Deposits: Points for a Racer’s own deposits. This Leaderboard is shown only to Racers, in Points and never in rand, and no Prize is awarded for it.
5.2 Racers are ranked by Confirmed Points, highest first. Where two Racers have the same Confirmed Points, the Racer whose Points reached that total first ranks higher, measured by when the Points were confirmed. No element of chance is used to rank Racers or to break a tie.
5.3 Only Racers are listed and ranked. A person suspended or excluded under clause 10 is not listed.
5.4 The top 100 Racers on the Overall, Invites and Friend Deposits Leaderboards are shown on the Race Page, which refreshes about every 60 seconds. All Racers can see every Leaderboard in the 80eight app and web app, but the Deposits Leaderboard is not shown on the Race Page. Each row shows rank, @username, Points and movement since the last hourly update. No other personal information is published.
5.5 Leaderboards are indicative until the Final Standings are confirmed.
6. Power Hours
6.1 The Company may, in its discretion, run Power Hours during the Race Period. During a Power Hour, Points for some or all qualifying actions, are multiplied by up to 5 (five).
6.2 A Power Hour applies equally to every Racer and only to actions that occur within its window. Where Power Hours overlap, only the highest multiplier applies.
6.3 The Company will publish each Power Hour on the Race Page and in the Race section of the 80eight app at least 30 (thirty) minutes before it starts, and no Power Hour starts earlier than that. A Power Hour runs for its published window. It may be cancelled before it starts, and once it has started it is not extended or ended early except because of a fraud, security or system problem. No Racer is entitled to any Power Hour, and no claim arises from missing one.
7. Prizes
7.1 The following Prizes are available:
| Prize | Awarded to | Amount |
|---|---|---|
| Overall first place | The Racer ranked 1st on the Overall Leaderboard in the Final Standings | R20 000,00 |
| Overall second to fifth place | The Racers ranked 2nd to 5th on the Overall Leaderboard, each receiving the amount shown for their place | 2nd place - R7 000,00 3rd place - R4 000,00 4th place - R2 000,00 5th place - R1 000,00 |
| Invites first place | The Racer ranked 1st on the Invites Leaderboard in the Final Standings | R8 000,00 |
| Friend Deposits first place | The Racer ranked 1st on the Friend Deposits Leaderboard in the Final Standings | R8 000,00 |
7.2 The total value of the Prizes is R50 000,00. The value of each Prize is fixed and will not be reduced.
7.3 Prizes are awarded by rank in the Final Standings. No element of chance determines a Winner. There is no Prize for the Deposits Leaderboard, and no Prize depends on a Racer having made a deposit.
7.4 To receive a Prize, a Racer must:
(a) be a Racer at the Close;
(b) hold KYC Approval, with the identity verified through KYC Approval showing that the Racer was at least 18 (eighteen) years old at the Start;
(c) not be excluded under clause 10 or be a person described in clause 2.4;
(d) pass the Company’s review under clause 8.3; and
(e) be a person to whom the Company may lawfully pay the Prize, including after the Company’s sanctions and FICA screening.
7.5 A Racer may win only one Prize. A Racer who qualifies for more than one Prize receives the Prize of the highest value, and the other Prize passes under clause 7.6.
7.6 Where a Prize is not awarded to the Racer who ranked for it, because the Racer is disqualified, does not meet clause 7.4 or cannot be paid under clause 9.5, that Racer is removed from the standings, the Racers below move up one place on that Leaderboard, and each receives the Prize for the place they then hold, provided they have passed the Company’s review. If there is no eligible Racer for a place, the Prize for that place is not awarded.
7.7 No Winner is required to attend any event, allow the use of their image or take part in any marketing, and may decline any such invitation.
8. Close, review and Final Standings
8.1 No Points are earned for actions occurring at or after the Close. Pending Points held at the Close confirm or are cancelled over the following 24 (twenty-four) hours.
8.2 Once no Points are on hold, the Company publishes provisional standings on the Race Page.
8.3 The Company then reviews every Racer in a Prize position, and the next 10 (ten) Racers ranked below each Prize position on the same Leaderboard, for compliance with these Race Terms. The review includes checks for shared identity, linked devices, deposit-and-withdraw cycling, self-referral rings, a common source of funds between a Racer and an Invited Friend, a match against the persons described in clause 2.4, and the Racer’s age. A Racer disqualified at review is removed from the standings, and the Racers below move up.
8.4 After the independent verifier has certified the standings under clause 8.5, two authorised persons of the Company confirm the Final Standings, which are then frozen and published on the Race Page.
8.5 The Company will appoint an independent accountant, registered auditor, attorney or advocate, who is not an employee of the Company or of The Dream Boys, to oversee the review, any suspension or exclusion decisions and the determination of the Final Standings, and to certify that they were determined in accordance with these Race Terms.
8.6 The Company’s determination of eligibility, Points, rank, the review and the Final Standings is final, subject to a Racer’s right to raise a complaint under clause 19 and to any applicable statutory rights.
8.7 The Final Standings are published on the Race Page, and each Winner is notified in the 80eight app, within 10 (ten) business days of the Close. A copy of these Race Terms is available free of charge on the Rules Page and from support@80eight.io. Prizes are paid into the Winner’s 80eight wallet.
9. Payment of Prizes
9.1 Prizes are paid in South African Rand into the Winner’s 80eight wallet within 10 (ten) business days of the Company confirming the Final Standings. A Prize paid into the wallet is wallet balance that may be used in the ordinary way under the Company’s Terms of Use.
9.2 A Winner is not required to pay anything, or to meet any condition that is not set out in these Race Terms, to receive a Prize.
9.3 Prizes are promotional in nature and do not constitute interest, a financial return or a contractual entitlement until credited to a Winner. The Company may withhold, delay or decline to pay a Prize while an eligibility, fraud or sanctions check is in progress or while a Racer is suspended under clause 10.3, and may decline to pay a Prize where it reasonably concludes that clause 7.4 or clause 10 has not been met.
9.4 Where the Company determines, acting reasonably, that a Prize was awarded on the basis of fraudulent, duplicated or otherwise ineligible activity, or in breach of these Race Terms, it may reverse the Prize and, if the Prize has already been credited, deduct the amount of that Prize, and no more, from the Winner’s 80eight wallet balance within 60 (sixty) days of the Prize being credited. Before doing so the Company will tell the Winner the reason and allow 5 (five) business days to respond, unless the law prevents it or the Company reasonably believes that waiting would put funds at risk. The Company will not deduct a Prize from any other funds or assets it holds for the Winner. If the wallet balance is less than the Prize, the shortfall is a debt that the Company may recover by lawful means. A Winner may raise a complaint under clause 19, and if a reversal is found to be wrong the Company will credit the amount back.
9.5 If a Prize cannot be paid because the Winner’s account is closed, blocked or restricted, the Company will take reasonable steps for 30 (thirty) days to pay it and will record the reason and the steps taken. If the Prize still cannot be paid, it passes under clause 7.6.
9.6 A Winner is responsible for any tax that arises from a Prize. The Company does not give tax advice.
10. Fraud, abuse and verification
10.1 The following conduct is prohibited and may result in exclusion from the Race, cancellation of Points, forfeiture of Prizes, reversal of Prizes already paid, and restriction or closure of the relevant account or accounts, without limiting any other rights the Company may have:
(a) creating or using more than one account, or using another person’s account, to earn Points or a Prize;
(b) self-referral, or colluding with another person to generate sign-ups, verifications, deposits or Points without genuine underlying participation;
(c) depositing and withdrawing funds, moving funds between accounts, or depositing funds that do not belong to the Racer or do not come from an account or card in the Racer’s own name, in order to earn Points, or funding, or arranging for another person to fund, an Invited Friend’s deposit in order to earn Points;
(d) using bots, scripts, automated tools, or paid or incentivised sign-up services to generate sign-ups, deposits or referrals;
(e) providing false or misleading information during registration or KYC, or using identity or banking details that do not belong to the account holder;
(f) using a username that is offensive, misleading or impersonates another person;
(g) when inviting others, sending unsolicited bulk messages or messages the recipient has not agreed to receive, making any statement about returns or guarantees, giving financial advice, or presenting yourself as an agent or representative of the Company; and
(h) any other conduct the Company reasonably considers to be an abuse of, or a threat to the integrity of, the Race.
10.2 To detect and prevent the conduct described above, the Company may have regard to any indicator it considers relevant, including IP address, device identifiers or device fingerprint, geolocation, banking or payment details, identity documentation, contact details, and account behaviour and transaction patterns. No single indicator is determinative, and the Company is not required to disclose the specific checks applied in any individual case.
10.3 The Company may suspend a Racer where it reasonably suspects fraud, abuse or a breach of these Race Terms, while it investigates. While a Racer is suspended, the Racer is removed from every Leaderboard and cannot be ranked or win a Prize, but the Company continues to record the Racer’s Points. The Company will decide each suspension before the Final Standings are confirmed. If the Company finds that the Racer did not breach these Race Terms and was not negligent in relation to the conduct that led to the suspension, the Company will restore the Racer to the Leaderboards with all of the Racer’s Points, including Points recorded during the suspension, as if the suspension had not happened. Negligent means failing to take reasonable care, for example by sharing log-in details or allowing another person to use the account, and a Racer is not treated as negligent because of the conduct of a friend the Racer invited unless the Racer knew, or ought reasonably to have known, of it. If the Company finds a breach or negligence, it may take any step in clause 10.1, including excluding the Racer, who then earns no further Points and cannot win a Prize. The Company will tell the Racer of a suspension or exclusion and the reason, will consider any response the Racer gives, and a Racer may raise a complaint under clause 19. The Company need not do so where the law prevents it or telling the Racer would put the Race or an investigation at risk.
10.4 The Company may require additional verification before paying, or before allowing withdrawal of, a Prize or any funds linked to it, including proof of address, source of funds, or confirmation that the receiving bank account or payment method is held in the name of the account holder.
10.5 The Company may report suspected unlawful activity to the relevant authorities as the law requires, and is not required to tell a Racer that it has done so.
11. Changes, pausing and ending the Race
11.1 The Company may pause, suspend or freeze the Race to deal with a technical fault, a security or fraud risk, a legal or regulatory requirement, or any other event beyond its reasonable control. While the Race is paused, actions continue to be recorded and earn Points, at the time they occurred, once the Race resumes. While the Race is frozen, no Points are earned.
11.2 The Close is fixed and the Company will not move it. The Company may end the Race early only where it is required to do so by law or a regulator, or where a fraud, security incident or system failure makes it impossible to run the Race fairly. If the Race ends early, the Company will determine the Final Standings as at the time it ends and Prizes will be awarded on that basis, unless the law or a regulator requires the Race to be cancelled.
11.3 The Company may change the Points Table or the weighting of the Leaderboards only to prevent fraud or abuse, to comply with the law or a regulator, or to correct an error. The Company may also switch off Points for a Racer’s own deposits, going forward, where it considers this necessary to protect Racers or to comply with the law or a regulator. A change applies only to actions that occur after it takes effect, is published on the Rules Page and in the Race section of the 80eight app, and does not reduce Points already earned, except under clauses 4.3, 4.10, 8.3 and 10.
11.4 The criteria in clause 2 apply throughout the Race Period. The Race is open to existing 80eight customers and to people who open an 80eight account during the Race Period, and each is an Eligible Person from the time they meet clause 2. The Company will not change those criteria during the Race Period except to comply with the law or a regulator or to prevent fraud or abuse, and it will publish any such change on the Rules Page and in the 80eight app. Nothing in this clause limits the Company’s right to suspend or exclude a person under clause 10.
11.5 The Company may amend these Race Terms before the Start. After the Start, it may do so only to correct an error, to comply with the law or a regulator, or as clauses 11.2 and 11.3 allow. It will publish the amended Race Terms on the Rules Page and notify Racers in the 80eight app. An amendment will not reduce a Prize or shorten the Race Period, except as clause 11.2 allows.
11.6 Participation in the Race does not entitle a person to participate in, or receive any benefit under, any future race or campaign.
12. Personal information and public display
12.1 By joining, a Racer consents to the Company publishing their 80eight username, Points, rank and movement on the Leaderboards, including on the Race Page. No name, photo, amount, identity number or account detail is published. A Racer may also choose to share an image of their own rank, which shows only their @username, rank, Points and invite link. Because Points for a Racer’s own deposits count at one quarter on the Overall Leaderboard, other people may be able to estimate roughly how much a Racer has deposited by comparing the public Leaderboards. By joining, a Racer accepts this and may leave the Race at any time under clause 3.5. By joining, a Racer also consents to the Company and The Dream Boys mentioning the Racer’s @username, rank and Points in shout-outs on their social media channels. No name, photo, amount or account detail is used.
12.2 A Racer who has invited a friend can see that friend’s @username, or first name and initial, and how far the friend has progressed (signed up, verified, funded). A Racer cannot see amounts or contact details. The Company’s Privacy Policy explains this to a person who registers with a referral code.
12.3 The Company processes personal information of a Racer to calculate Points from the time the Racer joins the Race, in accordance with the Company’s Privacy Policy. The Company does not calculate Points for an Eligible Person who has not joined, and a Racer may stop the calculation at any time by leaving the Race under clause 3.5.
12.4 The Company also processes personal information, including identity numbers, IP address, device information, and banking or payment details, to detect and prevent fraud and abuse of the Race under clause 10, which the Company considers necessary for its legitimate interests and its obligations as an accountable institution under the FIC Act.
12.5 A Racer may withdraw consent to public display and shout-outs at any time by leaving the Race under clause 3.5. A Racer may also ask, by contacting support@80eight.io, not to be mentioned in shout-outs, and the Company will ask The Dream Boys to stop. The Company cannot recall copies, screenshots, shared images or posts made by other people, including posts already published on social media, but will ask The Dream Boys to remove existing mentions where practicable.
12.6 The Dream Boys receive only what appears on the public Leaderboards, being each Racer’s @username, rank and Points, and may use it only for shout-outs under clause 14.3.
12.7 The Company keeps the Race records for at least 3 (three) years after the Close. These are these Race Terms and their versions, the marketing material and the dates, media and places where it was used, the Leaderboards and Final Standings, the review, exclusion and Power Hour records, and the Prize and Winner records.
12.8 A person may lodge a complaint about the processing of their personal information with the Information Regulator.
13. Invitations and messages
13.1 A Racer invites friends by sharing their own code or @username link from their own device. The Company does not send messages to people who are not its customers on a Racer’s behalf.
13.2 A Racer who invites others must comply with clause 10.1(g) and with the law on unsolicited electronic messages, and must not use the Company’s name or logo except in the share images and materials the Company makes available.
13.3 The Company may send Race notifications, including about a Racer’s rank and Power Hours, to users in accordance with each user’s communication preferences and marketing consent. Notifications are sent only at times the law allows for direct marketing. Each marketing message identifies the Company and tells the user how to stop such messages in the notification settings of the 80eight app. Messages about a Racer’s own joining, leaving, exclusion or Prize, and about changes to these Race Terms, are service messages and are sent regardless.
13.4 Unless the Company announces otherwise on the Rules Page, the Company does not send reminders to Invited Friends on behalf of a Racer. If it does, each reminder will respect the recipient’s communication preferences, will be sent only at times the law allows for direct marketing, and will include a way to stop reminders.
14. The Dream Boys
14.1 The Race is run by the Company in partnership with The Dream Boys. The Dream Boys are an independent marketing partner of the Company. They are not an employee, representative or agent of the Company and are not authorised to give financial advice on the Company’s behalf. The Dream Boys have a commercial and financial relationship with the Company in connection with their promotion of 80eight, including the Race.
14.2 The Company alone decides eligibility, Points, rankings, the review, the Final Standings and the Prizes. The Dream Boys have no part in those decisions.
14.3 The Dream Boys may mention Racers in shout-outs on their social media channels. A mention uses only the Racer’s @username, rank and Points as they appear on the Leaderboards, never refers to deposits, amounts or the Deposits Leaderboard, and is not a Prize. Shout-outs are at the discretion of The Dream Boys, carry the paid partnership disclosure, and give no financial advice. The Company may ask The Dream Boys to remove a mention at any time.
15. Not financial advice
15.1 Participation in the Race, and receipt of a Prize, does not constitute financial advice and should not be treated as a recommendation to open an account, make a deposit, or use any 80eight product. Users should refer to the Company’s standard risk disclosures and Terms of Use before making any financial decision. 80 Eight SA (Pty) Ltd is an authorised financial services provider (FSP 49010).
16. Limitation of liability
16.1 The Company is not liable for any delay in, or failure to, award, record or display Points, update a Leaderboard, deliver a notification, or credit a Prize, caused by system downtime, a third-party platform or payment rail, incorrect information provided by the user, or circumstances beyond the Company’s reasonable control. Nothing in this clause limits any liability that cannot lawfully be excluded, including under the Consumer Protection Act 68 of 2008.
17. General
17.1 If any provision of these Race Terms is found unlawful or unenforceable, the remaining provisions continue in force.
17.2 The Company may transfer or assign its rights and obligations under these Race Terms in connection with any restructuring, merger or transfer of its business, on notice to affected users where required by law.
17.3 All amounts in these Race Terms are in South African Rand and all times are SAST.
17.4 These Race Terms, the Terms of Use and the Privacy Policy are the whole agreement between the Company and a Racer about the Race.
18. Governing law
18.1 These Race Terms are governed by the laws of the Republic of South Africa, and users submit to the exclusive jurisdiction of the South African courts.
19. Queries and complaints
19.1 Questions about the Race can be directed to support@80eight.io. A complaint is handled under the Company’s Complaints Policy. A Racer who is not satisfied may also lodge a complaint with the National Consumer Commission.
